Appeal against the selection of the most advantageous tender by PKP PLKThe Management Board of Atende S.A. (′Issuer′), with reference to the current report No 13/2017 dated September 22nd reports that on November 6th, 2017 it became aware that on November 4th, 2017 the leader of the consortium of: Fonbud S.A. - sp.k. (consortium leader), Atende S.A., South Korean company ICRAFT Co. Ltd. and Ukrainian company UKRCOM LLC. (together the ′Consortium′) filed an appeal to the National Chamber of Appeal against the selection made by PKP Polskie Linie Kolejowe S.A. (the ′Employer′) in the procedure for the ′Construction of the ERTMS/GSM-R system infrastructure on PKP Polskie Linie Kolejowe S.A. railway lines under NPW ERTMS′, case No: 6060/ICZ4/08860/03374/15/P, part 2 of the contract – Implementation of Backbone Transmission Network. The Employer selected a competitive tender as the most advantageous and rejected the Consortium’s tender pursuant to Article 89 Section 1 item 2 of the Public Procurement Law. The Issuer will inform about the result of the appeal.
