The Management Board of Atende S.A. (′Company′) hereby reports that on June 30th, 2015 a Contract was signed for building and implementation of data centres, data processing and archiving centres (′Contract′) between the Company and Resortowe Centrum Zarządzania Sieciami i Usługami Teleinformatycznymi [Departmental Centre for ITC Networks and Services Management] (′Employer′). The value of the contract is PLN 66.4 million gross. The terms and conditions of the Contract do not differ from standard terms and conditions for this type of services.

The contract provides for delivery of a virtualization platform, expansion of the existing virtualisation platform as well as supply of hardware and software for the archives of electronic documents, including the services of installation, implementation, maintenance and training. The deadline for the completion of the implementation under the contract was set for December 15th, 2016. The contractor will provide warranty maintenance services for 36 months.

The contract imposes the liquidated damages of 20% of the gross value of the Contract for withdrawal from the Contract by the Employer due to circumstances attributable to the contractor, 0.2% of the gross value of the Contract for each day of delay in completion of the entire subject matter of the Agreement, and PLN 2,000 gross for each day of delay in performance of the guarantee obligations under the Contract. The provisions on liquidated damages do not exclude the Employer’s right to seek damages on general principles of the Civil Code.

A contract or agreement is recognised as significant if its value exceeds the amount of 10% of total sales revenue of the Issuer’s Capital Group for the last four financial quarters, which amounted to PLN 213,558 thousand.
